WHY WAS THIS SITE MADE?
When
Representative Mert Smiley first suggested in his
legislative hearing last April that he might want to
combine the services of the LSBPIE under another board
as a cost savings measure, many of us opposed that
concept. We recognized that there were problems
but incoming Chairman
John Mowell promised change and an
open forum like we had never seen before. We fell
for it hook, line and sinker and the changes that were
promised actually created less open communication.
CHANGE MUST
COME and upon reflection, it would appear that the
LSBPIE believes that they can do whatever they want,
whenever they want, regardless of the rules or the law.
COMPLAINTS
WERE FILED, but we believe that the best chance for
change is with the legislative session and will propose
two bills, one to change the make up of this board and
the other to abolish it and place its duties under the
scope and authority of another governmental entity.

BOARD MEMBERS ARE
APPOINTED BY THE GOVERNOR
The
board shall be comprised of seven members appointed by
the governor. One member shall be appointed from each of
the five public service commission districts as
established by law and shall be a resident of the
district from which he is appointed.
The
governor shall appoint one licensed attorney to serve on
the board from the state at large and one member from
the state at large appointed from a list of names
submitted by the board of directors of the Louisiana
Private Investigators Association. *
Each
member of the board shall be a citizen of the United
States of America, a resident of Louisiana, at least
twenty-one years of age and, except for the attorney
appointed from the state at large, shall have been
actively engaged in the private investigator business
for the previous five years, earning at least ninety
percent of his gross income for the year preceding his
appointment from the private investigator business. No
more than two board members may be employed by or
affiliated with the same agency. The initial board
members shall not be required to be licensed but shall
obtain a license within one hundred eighty days after
appointment to the board. Each subsequent member shall
be a licensed private investigator.
* We
argue that the Louisiana Private Investigator
Association, with a membership of less than 100 members
is unfairly provided the right to effectively choose a
board member by submitting a list of names to the
Governor by which the Governor must appoint a member
from that list. It should be noted that LPIA
President Paul Dugas submitted his wife's name, who the
Governor chose to the LPIA Member at Large.
This needs
to be changed! There are currently in excess of
1300 licensed private investigators in the State of
Louisiana, and of that number, less than 100 are members
of the LPIA, who then decides one member on the State
Board.
JOHN MOWELL CHAIRMAN
Author of the Board's
newsletter and proclaimed that under his leadership
the board would become open and as transparent as
possible. Almost immediately, investigators
were told that they could not contact board members
directly because of the new rules.
Author of a "white
paper" that attempts to define the topic of
Investigative experience, something that the board
has failed to do in the 19 years of existence.
We also give Mr. Mowell credit for attempting to
compile a "policy manual" of the boards resolutions
into one format. After 19 years, we think that
its time, but we have yet to see the policy manual
and noticed that it was again on the agenda
10-25-2011.

Mr. Mowell told the
State Board of Ethics that he is not directly
involved in the approval of training and education
courses when he requested an opinion as to whether
or not he could BE PAID to teach continuing
education classes. We find it
interesting that the minutes show that Mr. Mowell is
involved in continuing education approvals or most
recently killing it. READ THE ETHICS OPINION
As of November 1, 2010
an investigator discovered that Mr. Mowell had
continued to advertised that he was a Texas licensed
investigator on his website AFTER his Texas License
# A14593 had expired on 9/12/2009 according to the
Texas Private Security Bureau website. After a
complaint was filed, Mr. Mowell then applied for a
new Texas License on 11-17-2010; the very same day
that the complaint was filed. Our information
is that he attempted to renew his license when he
discovered the complaint, but was required to file a
completely new application because it had been
expired over the grace period. READ THE COMPLAINT SENT BY AN INVESTIGATOR
Failed
to file his required Ethics Financial Statement
until an investigator filed for the public records
of his statements in early 2011, at which time, Mr.
Mowell filed all of the financial statements at the
same time.
To his credit, Mr.
Mowell's company in Louisiana has always been in
good standing with the Secretary of State.
LANCE WALLACE
VICE CHAIRMAN
As far as we can find, Lance Wallace is in full
compliance with the State of Louisiana and has not
been the subject of any scandal while serving on the
board. He is to be congratulated for that,
however he did vote to abolish the CE in violation
of the Administrative Rules and Regulations.
BRUCE CHILDERS
INVESTIGATIVE OFFICER
Formerly a board member
under Governor Mike Foster before resigning.
Bruce Childers was responsible for the closure of
public comments before the law was changed to
require public comments in all board members.
In fact, his refusal to allow the public to speak
out was a rally cry that brought the issue to the
attention of those that ultimately called for the
law to force boards to allow public comments.
Appointed by Governor
Bobby Jindal for another term, it would seek that
not only cats have nine lives. I think if we
keep having the same person in charge, is it really
prudent to expect different results?
Currently the subject
of a complaint in which it is alleged that he does
not meet the requirements to hold a private
investigator's license. He is licensed under
the name of Investigations Unlimited, but in
documents submitted to the Board office that require
investigators seeking agency licenses, he submitted
the name of Accuscreen Systems. His license
was issued in violation of the law since his
occupational license did not match his company name
that he was licensed under.

His
companies authority to operate in Louisiana was
revoked by the Secretary of State on August 18, 2009
however Mr. Landry continued to operate his business
and remained on the private investigator's board,
sitting in judgment of others. It was not
until this was brought to his attention in May that
he finally corrected the issue and filed for
re-instatement on 9-28-2011.

MARIA DUGAS
LPIA MEMBER AT LARGE
EDUCATION & TRAINING CHAIRMAN
Currently a student of the law and a partner in her
family investigative business, her company has been
the subject of a number of complaints filed by
another investigator, regarding various business
practices, among them the fact that they do not use
the name(*) that they were licensed under on their
website and use of (**) video of actual
investigations on their website, in what the
complaint felt was a violation of privacy of the
subjects.
Appointed to the LSBPIE
board after her husband, then President of the LPIA
recommended her in the list of names submitted to
the Governor to be appointed to the Board. READ THE LETTER You might notice that
Maria Dugas name is listed first and that the letter
also recommends that Kennith Landry be appointed as
well.
Ms. Dugas will long be
remembered as "the LPIA member at large" that filed
a complaint on the CE program of the LPIA even after
complimenting the LPIA for the quality of the
programs. She also spoke out to the
legislative session in which she made statements to
reflect the following:
Most agency owners
are members of the Louisiana Private Investigators
Association.
The number of agency
owners in Louisiana was said to be much lower than
the actual number of approximately 600
Her
initial focus on the training program was a
commendable approach because she promised the board
that she would get the law students at her
university to research and rewrite the training
manual at zero cost to the board. In fact, she
told the legislative members this very statement.
But to date, we have not seen it, so I wonder what
the status of this project is.
Maria Dugas states that out of the 1300 - 1500
licensed Private Investigators, there are about 300
that are
actually agencies and about one half of those
represent the membership of the LPIA.
CORRECTION
On the day that she states this, there were in
excess of 600 agencies - NOT 300 as was
reported to the committee
CORRECTION
Of the then 140 members of the LPIA, about
half are agency owners. This would make
the number of agencies at about 70-80 instead.
THE LPIA DOES NOT REPRESENT THE MAJORITY OF
THE LICENSED INVESTIGATORS.
CORRECTION
The LPIA has never acted as
a Watch Dog to catch things that were going on
with the LSBPIE. In fact, the LPIA has
been a part of choosing the board members.
In truth, PI-TALK and the efforts of a small
number of activists have been the watch dog of
the industry.
Her corporation, The Investigative Network was
revoked in 2003 but she has continued to be a
licensed investigator because the LSBPIE continued
to renew her license.

Kovac was asked to resign from her position on the
Board due to the appearance of wrong doing, with her
being issued a license without meeting the
requirements of holding a license, but she has not
resigned.
In
fact, recently she made a motion that impacted the
author negatively to suspend the continuing
education program, even thought she knew that there
was an open complaint against her by the author and
in doing so stated "So he can come throw Rotten
Tomatoes at me". One would think it would be
unethical to sit on a committee in judgment of a
person that has an open complaint filed against you,
but that speaks for the integrity of each person and
no claim is made about Ms. Kovac.
Read this
screen shot from the March 16, 2010- at a time when
the chairman was not even in compliance, the Board
holds others accountable. Kovac isn't the only
one!
CALVIN C. FAYARD, III
"TREY"
HEARING OFFICER AND PERSONNEL CHAIRMAN
As far as we can find, Mr. Fayard is in compliance
with all the requirements to be a board member,
however he did vote to abolish the CE in violation
of the Administrative Rules and Regulations.
He is a licensed attorney. If the name is
familiar, his sister, Caroline Fayard ran
unsuccessfully for Lt Governor of Louisiana and is a
attorney as well. Mr. Fayard chaired the
informal hearing and thereafter voted to abolish the
CE in what we strongly believe was a violation
of the Administrative Rules and Regulations.
The records will
reflect that Mr. Fayard does not attend all of the
board meetings, as we are sure that he is a very
busy man.
NEW
INFORMATION HAS BEEN DISCOVERED:
Previously overlooked, information has been brought
to our attention that Trey Fayard may have been
issued an investigative letter relative to an
ongoing probe into ethics violations regarding
campaign funds. From the website located at

this comment was posted:
Perhaps a real-world litmus test for the Jindal
ethics reform will come soon enough with one of his
appointees. Calvin C. Fayard, III ("Trey") was
appointed by Jindal to the Louisiana Board for
Private Investigator Examiners in 2009 or 2010.
According to court pleadings filed recently on
behalf of DEMOPAC and almost the entire Calvin C.
Fayard, Jr. Family, Trey Fayard has been issued an
investigation letter and likely a subpoena or 2 from
the Ethics Board in connection with his campaign
contributions to DEMOPAC in 2010. In January
2009........
IT IS IMPORTANT TO NOTE
THAT TREY FAYARD HAS NOT BEEN INDICTED AND MAY NOT
EVEN BE A LEGITIMATE PARTY TO THIS ACTION, But the
question does rise as to whether or not he should
serve in judgment of others while this is going on
and that is our point.
SO I HAVE TO ASK?
Is there a board member on this board that is completely
above board with no issues that would cause one to
question their service on the board? Right
now, Lance Wallace appears to be the lone wolf....but
I'm still waiting for what's next. Sort of makes
you wonder doesn't it?

Who was it that said the definition of insanity is to
keep doing the same thing and expecting different
results. Look closely and see if you see a pattern
